when does a detainment cross the line from legal to illegal? what would the criteria be for it being legal in the first place in this situation? can they really detain you because you don't look 21 and are drinking and they can't figure out if an out of state license is real or not?

agreed on the Arrested misnomer.....

being cuffed, put in a car, taken to a station doesn't = arrested unless you get processed, correct?

for underaged drinking.... I'm 25 years old. I tried to order a beer and they took my LEGAL CALIFORNIA ID and they denied it... i asked for the manager, and he was a prick and i told him to stop being a douche and learn his state ID's, and that I had already had two beers at the other bar... ((WE NEED THE DETAILS ON WHAT HAPPENED HERE, AND WHY THE POLICE BECAME INVOLVED )) next thing you know a cop is putting cuffs on me.

fast forward and I'm in the office and they're asking me all these questions about when I graduated college, etc. and I even showed them my Linkedin account for proof of when I graduated.

They FINALLY get their machine working, and they swipe my ID to see that it is a valid license... but I guess they were trying to prove something... b/c even though they had proof they kept questioning me. I finally just told them to let me go so I could go home. I already left my friend out there and i'd missed the entire Doobie Brothers set. Next thing you know, my Best friend JL comes in with a scanned copy of my passport from an email on the screen of her phone (she called my dad, who has a copy of my passport, so he scanned it and sent it in an email to her). Then they FINALLY let me go.

i've been drinking for 10 years. only legally for 4. and NOW they arrest me?

Because it was pouring rain, I was soaking wet in an Abercrombie and Fitch sweatshirt looking like I was 15 years old and they took my I'D and denied it and wouldn't give it back. So I was nice about it, but when the guy threatened to cit my legal I'D in half bc I was a "little liar" I flipped out and demanded the manager and the security dude walked away so I ran after him since he still had my I'D and he turned around and I yelled at him in front of the head security dude who told me I was being drunk and disorderly and underaged. That's when they cuffed me. I had 2 beers.in total the whole night. I wasn't drunk I was insanely angry
 
On behalf of the fat and uglies out there that would have been made fun of as in previous Cali threads I salute the security guards for preventing this. It could have only been better had she actually been place in the back of a paddy wagon wedged snugly between a couple of the beefiest of my brethren.
 
The people at the Arts Center can be drama queens.

For instance what happened to me is I was recruiting with a friend for a shitty job and I had never had Jager before so I drank the whole bottle which I know I could handle. Anyway it was a No Doubt concert and there were a lot of parents there with their kids and I ended up getting violently ill in the middle of the crowd. The parents got the cops and I woke up in the hospital getting my stomach pumped. I do remember screaming at all the EMT's as they wheeled me off. I could have easily slept it off.

Bullshit.

so it wasn't police? were they off duty maybe? or just bouncers with cuffs? they just took you to the bar's office? not the station?

did you check and see if the cuffs were the plastic ones you can buy for kids at the store?
 
The fact that they were security makes it MORE likely that you would have a civil action for unlawful imprisonment. If it were police you would probably have a section 1983 action (and state equivilent) for unconstitutional seizure to but as Daft said, they were prolly w/in their right and you would lose. All about the facts.
 
Fact: you weren't arrested
Fact : you were detained or questioned for being loud, and obnoxious when you didnt get your beer.
no harm, no foul...
lesson learned : next time go to the same vendor to get your $8 beers at a concert....

or smuggle in a flask and save the $50 it cost to get drunk at a concert

Real cuffs. Took me to the security office where they have a holding room where they keep the drunk and disorderly. Luckily I just sat on the bench my the door while they looked up my lisence in some system.

How do you not carry other forms of identification as well? Social security card, credit cards, health insurance, etc.

A lot of places require a second form of ID. If you've been drinking for 10 years, you should know that by now.

I gave them all my credit cards, my health insurance card and my.debit card which has my pic on it. But none have my birthdate on them
