You could likely sue for an unauthorized recorded telephone conversation. A recording of a public protest no, there was no expectation of privacy.

On the pay for testimony thing there is no impropriety. People pay for testimony all the time and any good opposing attorney will make sure the jury knows it. Usually even when they know they don't seem to care. Expert witnesses get paid boat loads of cash.

Ok. You're not biting quickly enough and I have to go to bed. An esteemed GL poster found it on the dentist's facebook page. The dentist also posted a video of you picketing. Is Ben the one who broke into his office?

If I could post the video(s) alone I would, but not sure we should link to the FB page, although some ruiner from SP Nation already did. It's not hard to find if you look for it.

Usually only one party to the conversation has to be aware that it is being recorded. It varies from state to state, but that is the overwhelming precedent I believe. At least it was a million years ago when I studied criminal law.


Also, Casper is not an expert witness...he would be testifying to facts, and pretty sure it would be very unethical/illegal for him to receive pay. The hotel might be ok, but actual cash? Pretty sure no...but again could vary from state to state and court to court.
 
Don't quit your day job iag. We've established in this thread that MA is two party consent (actually a bar on secret recording, essentially two party consent). Never said caspy was expert. Just used that point to pay for testimony be legit and quite commonplace. Hell, we don't even know what proceeding he'd be testifying in (civil, criminal, court of public opinion, just cause hearing, etc). In any of those its probably permissible that he's paid.
