I see in the body of the article that Boney linked that Mr. Menace2Society did (per the PROSECUTION) threaten violence to include death.

The State says he had no means to carry out such a threat. How was the Marine supposed to know in that moment that Mr. Menace2Society didn’t have an instrument on his person that could cause great bodily harm/death to someone in the train car?

I definitely feel he shouldn’t have been prosecuted. I do think the hero term has been overused in this case however.

I think he did what he felt needed to be done and the majority of people on the subway agreed.
