My new neighbour is trying to claim 2 feet of my property

. If you are young and single it could be a nice revenue generator as you can take in roomies which basically pay your mortgage and you could get to live for free while building equity.

thats what I hope to do by the end of next year, just got to get more money saved for a down payment. Some good deals in the area I have been looking at.

sorry to hear about your neighbor, puckoff. you probably don't need a lawyer, though, unless you're planning to go through a court to deal with this. unsure about how they do it in canada, but don't you have a copy of the original survey or plot lines?
 
I'd go the route Wal suggested. call the local building dept, get records, problem solved...
but might be different up there in the great white north.

original site plan from when the house was built will have the property lines marked. building dept would have the records
 
Pucky, I just text's my golfing buddy who owns a surveying company cause the price you suggested seemed way high. I figured your lawyer quoted you that price and he was hosing you. My buddy agrees that if it came from the lawyer then he is inflating it but also said there are many variables and it all boils down to the legal description required that it could range from $350 to $1500.

Wally, the $350 is just a boundary survey to make sure your house is inside the boundary. When they have to do a more indepth survey then it costs more. My lawyer just mentioned that the price could be as high as $1750, but he also mentioned it could be less. The lawyer was just preparing me for the worse case scenario.
 
Can't you sue them after to recover the expenses?

RJ, my lawyer already mentioned that. He is sending off another letter to them this morning. The good thing about this is that my lawyer and I have identical names so maybe the other lawyer will see this and tell hsi client that we may be related therefore I will not be paying any legal fees. Who knows!!

I have the plot lines, but it's not an original survey.

My plot if 40' X 100'. As far as I'm concerned the new neighbour doesn't have a case at all. I don't know where he's getting this shit about owning or wanting to claim 2' of my property.
