But I just despise this feigned outrage, like everybody else in the nba is so loving and honorable. I really hate that shit. Sanctimony? is that the right word.

They banned him for life and they will pay him 1 billion dollars to sell the team he bought for 10 million. I'm pretty sure Don Sterling is laughing all the way to the bank. Now he can watch the games on the big screen TV while he counts his billions.

That's a criminal penalty I assume. I bet he could throw out a civil/tort suit for intentional infliction of emotional distress/duress for much more.

Well, I don't know, but I doubt it. This isn't slander. The only law broken was recording the call, and I don't think that's a major offence. It would be legal in most states.

I could be completely wrong.

I know it's not slander. I'm talking about a civil Tort...not based on the illegal act itself..intentional infliction of emotional distress.

But simply intentionally causing emotional distress isn't illegal. For instance, if these were letters written to Sterling's GF, there would be no issue at all.

There are 4 components of the tort of IIOED. I don't remember them all. You are going to make me look them up aren't you? I am not sure you are differentiating between criminal and civil or tort law here. It really has nothing to do with whether or not the recording itself was legal or not.
 
You guys need to look up the meaning of Tort. We are not talking about defamation or slander or any other illegal act per se.

Here is an example. Girl and boyfriend Skype. He records it unbeknownst to her . She breaks up with him. He posts video for revenge on the internet which is not illegal in their state. She sues for intentional infliction of emotional distress (a tort) and wins.

I don't know if it's worth his time and it may be she has a defense of some sort of serving a public good. I'm just saying there is definitely a case that could be made. I have seen the exact same sort of case law but can't locate it now. The same case could have been made if California only required one party to the conversation to have prior knowledge. It has nothing to do with the legality of the recording..but rather her intention to cause him embarrassment.

I just really doubt that this has the makings of a big civil lawsuit.

Is a person really that protected from their own words going public?

when the illegal act is the primary cause of a 2.5 mil fine, even if he dodges the fine, he should be going after everything she has.
