If the US wants other nations to turn over people wanted in the US then it would probably be a good idea to reciprocate.

Plus I'm fairly certain there are extradition treaties in place between the two countries.

I think with the way this case has gone back and forth that the US would not send her back to Italy.

You think the US would break an agreement with an ally because they don't agree with the foreign court?

That sets a precedence that would basically open the door for other countries to do the same to the US when they issue extradition requests.

Whats the point of having treaties/agreements/contracts with the US if they are subject to being broken because the US doesn't like something?

Not that it isn't possible, the US has disobeyed court decisions that were won by the Canadian government regarding tariffs illegally collected by the US government from Canadian companies - breaking the rules of the Canada/US free trade agreement.

I think they should put her in a small pod with full food, water, top of the line beverages and drugs and shoot her out into space with a very angry Ray Ray who is fresh off of losing 20 bets in a row and keep them out there for one week.
 
I know the US has laws against double jeopardy, this is about respecting the decision of a foreign court that you have an extradition agreement with.

You think Italian (or any European) justice is more severe than US justice?

If Italy files an official request with the US to extradite and the US says "no thank you" it will give other nations reason to ignore US requests for extradition from their country.

USA and Italy are allies, not enemies.

I think the US is obliged to turn her over to Italian authorities if requested to do so.

Having said that the US could possibly negotiate with the Italians.

I know Canada will not extradite a Canadian citizen to the US to face the death penalty but as soon as the guarantee of no death penalty is authorized from the US court Canada will extradite.


Plommer, you are forgetting that America is the greatest country in the world. Won't they just say "fuck you" to Italy and anyone else. Don't they do that now?

I don't think its that simple.

The US has requested help from the Italian government in the past with extradition and the Italians complied.

I'm not saying the US will deny the request, I can't know what will happen but the US should honor their agreements.

Breaking an agreement opens the door for other countries to return the favour.

It's really a no brainer IMO, you have a contract/agreement, you honour/abide by it.

I'm pretty sure even the people in the US government understand that, because they are great leaders and the world looks to them for direction/guidance.

I understand that, I'm sure there are provisions in the agreements. I'm no expert, just sharing an opinion. It's my opinion that unless there is a provision specifying so that US law does not supercede the law of the land of where the court is located.

The US recognizes the Italian court/justice as being competent and fair so I don't think they should be able to argue that US law would have an effect on their decision to extradite.

Perhaps they could argue over penalty - ie cruel and unusual punishment, like Canada does, the Canucks won't extradite someone if they are facing the death penalty, they will negotiate for life imprisonment (or less) and then agree to turn the person over.
