The NFL should have said, yeah he probably did stuff - a bunch of guys did - our system for handling game balls was beyond idiotic - we have basically been inviting trouble - but whatever, Brady is the one we caught - so we will fine him, oh, say, 20K - and implement a less completely-retarded system from now on.
