Well it is tough because in the United States it is supposed to be 3 Felony convictions and you are in jail for life. It doesn't always work that way but it is something that criminals are always afraid of and why we don't see as many career criminals in the United States anymore. Obviously some get out on loopholes and such.....

Well its not all of the states but here is a list of the 3 strikes law and when it was implemented in each state.

In 1974: Texas[4]
In 1993: Washington
In 1994: California, Colorado, Connecticut, Indiana, Kansas, Nevada, North Dakota
In 1995: Arkansas, Georgia, Maryland, Montana, New Jersey, New Mexico, North Carolina, Pennsylvania, South Carolina, Utah, Vermont, Wisconsin
In 1996: Florida, Tennessee, Virginia.

So by misdemeanor, do the cops throw you in jail for a couple days or just write you a ticket an dyou pay the fine. Do you have to go to court for a misdemeanor?

It's a simple distinction, really. Felonies are crimes in the U.S. for which the statutory sentencing requires at least a year of incarceration, misdemeanors are the crimes which allows for sentences less than one year. You do have to go to court for misdemeanors, but you are not indicted. To be charged with a felony, either a judge or grand jury has to find prima facie evidence of your crime.

Even though felons are sentenced to a year, jail crowding has reduced the average ratio of time served to time sentenced, for instance my 7 month sentence turned into 13 weeks served.

Felony DUI Causing Injury. Since the injured party was my fiance at the time the prosecutors made a deal with me that I could plead to Misdemeanor DUI with Property Damage so the sentence would be shorter. Even that was awfully draconian, if her father hadn't been a county prosecutor I could've gotten off with just a hefty fine and a grip of community service/probation. As it stands, I still have just under two years of supervised probation to deal with before it all goes away.

Oh, I should also point out that the injury was extremely superficial. She broke her nose against the dashboard when we finally came to rest in the creek. My insurance got ner a rhinoplasty to make it pretty again, and then she still sued me for $40k for pain and suffering and lost wages while her nose was healing. I lost the lawsuit.

No, her entire family hated me. They thought I was a lazy derelict to be growing pot when I have a college degree and marketable skills in a few different fields. I hated them just as much, they all thought their shit didn't stink and always tried to rub their aristocratic lifestyle in my face. I'm amazed she and I lasted the 3 years we did.

Fiver: The accident happened on July 30th, I was sentenced a month later, and by the time I got out she had already cheated on me twice and never come to visit me once. We finally broke up on Christmas Day. Honestly, with how that imprinted on me about women, society is lucky I don't walk around shooting women in the face at random. I was always attracted to men but that whole experience means I could never trust another woman again, save my Mother.
